We guarantee that all of our products are brand new, genuine and in their original packaging.

We are under no obligation to refund the transaction if the customer can not, or chooses not, to verify the information requested. We may need to verify larger sized orders. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed fraudulently.

Section 10 - Cherry Banana loyalty dollars

Loyalty Dollars can only be used on the Cherry Banana website and you must have an account to earn and use your Loyalty Dollars. Outside of our website they have no monetary value and cannot be used for any purpose other than the use on our website. At no time will Loyalty Dollars be available to be refunded for their cash value.

We may from time to time adjust your Loyalty Dollars upwards or downwards in respect to accounting errors, multiple accounts, refunds issued, products returned or suspected fraud, for which we have full authority. We reserve the right to remove loyalty dollars completely, cancel or close accounts at our discretion for situations including fraud and abuse.

Section 11 - Website and product reviews

All product reviews submitted on our website by Cherry Banana members are done so willingly and become the intellectual property of Cherry Banana. We reserve the right to display such property at its discretion. All reviews undergo moderation prior to being displayed on our website and may be rejected at the discretion of a Cherry Banana administrator.

Section 13 - Affiliate program

Affiliates may not make use of any Cherry Banana trademarks, such as the Cherry Banana brand name or any trademarked products (and that includes any variations or misspells of the brand name and trademarks) in their PPC ads and domain names.

PPC Restrictions: Cherry Banana has an extensive in-house PPC program. We do not want affiliates to compete with our own campaign or to drive up our costs.

• PPC bidding on the Cherry Banana brand name is not allowed.
• Similarly we do not allow bidding on variations or misspellings of the brand name (such as CherryBanana, Banana Cherry or Cherry Bananas).
• Using the Cherry Banana URL as your display URL is likewise not allowed.
• You may not make use of Cherry Banana trademark names in your PPC ads.

We will reverse commissions and reject any affiliates found breaking our PPC Restrictions.

Section 14 - Disclaimer of warranties, limitation of liability

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.

We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use.

Section 15 - International Orders, Laws & Customs

Cherry Banana is able to ship to any country in the world, but it is up to the customer to be familiar with and follow any legal requirement in regards to importing and receiving sex toys, adult products and items of this nature in their country. Cherry Banana will not be held liable for any package seized by customs for whatever reason. We will do our best to help resolve the issue, but the onus of clearing and receiving the imported packages from customs is up to the purchasing customer. At no time will an order be refunded if a package is seized by customs due to importing laws and restrictions.

The customer is accountable for any customs or import duties that may apply to the delivery process depending on the circumstance. We have no control over this process and is based on each receiving countries laws and procedures. We ship and declare all packages in a safe and discreet manner.

The exception to these terms are our Cherry Dolls. We handle all customs related procedures and pay any applicable importing duties and taxes. We will also resolve any issues in regards to Cherry Doll seizures, lost packages or other customs/delivery related issues related to Cherry Dolls.

Section 16 - Severability

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

These Terms and Conditions are governed by the laws of Australia.

Cherry Banana reserves the right to amend these terms and conditions from time to time.
